2.32.010 Established--Statutory authority. The authority for the establishment and regulation of the cemetery is provided in Colorado Revised Statutes, as amended, Section 31-25-701, et seq. (Ord. 675-87)
2.32.020 Operation and maintenance--Rules and regulations.
A. The operation and maintenance of the Evans Cemetery shall be under the general supervision and control of the director of parks and recreation.
B. The city council may adopt, by resolution, rules and regulations for the city cemetery and may, by resolution, amend such rules. (Ord. 1124-98: 675-87)
2.32.030 Record keeping requirements. The city clerk shall keep all records of burials, the sale of cemetery lots and prepare deeds for signature of the city clerk and mayor. (Ord. 1124-98: 675-87)
2.32.040 Cemetery endowment fund established--Authorized disbursement. There shall be established a trust fund called the cemetery endowment fund. Such trust shall consist of a combination of the present Henry F. Behrens Cemetery Trust and the Weld County Cemetery Trust. The city is further empowered to accept any additional donations to enhance the corpus of the trust. The corpus (principal) of the trust shall not be depleted, but the earnings from the trust may be used, buy only for the following purposes:
A. For the purchase of additional cemetery space for the enlargement of the cemetery at the discretion of the city council;
B. For investments, and the interest therefrom shall be used for the general care of the cemetery. (Ord. 675-87)
2.32.050 Deposit of collected funds. All funds received from cemetery lot sales, grave openings and closings, donations, interest from the cemetery endowment fund, and similar receipts shall be deposited in the city general fund. (Ord. 675-87)
2.32.060 Perpetual care fund. There is created and established a special fund, to be known as the "Evans Cemetery Perpetual Care Fund." The city council may, by resolution, provide for the collection of a fee: (1) from the sale of cemetery lots, (2) for the interment of opening/closing of a grave, and/or (3) by an annual assessment on cemetery lots. Such fees shall be deposited in the perpetual care fund to be used only for the following purposes:
A. For the care and maintenance of the cemetery grounds;
B. For the capital improvements necessary for upkeep of the cemetery;
C. For equipment necessary for maintenance of the cemetery. (Ord. 675-87)
