2.19.010 Created. There is created the Volunteer Firefighter Pension Board, hereinafter referred to as the ABoard@, which shall consist of seven (7) members. (Ord. 1183-99)
2.19.020 Term of Office and Membership. The Board shall consist of the City of Evans Mayor, for a term equal to the Mayor’s tenure as Mayor, the City of Evans City Manager, for a term equal to the City Manager’s tenure with the City, the City of Evans Treasurer, for a term equal to the Treasurer’s tenure with the City, the City of Evans Fire Chief, for a term equal to the Fire Chief’s tenure with the City, and three (3) volunteer fire department members elected by the Evans Volunteer Fire Department for three-year (3) terms, except that, at the initial election, one such member shall be elected for a term of three (3) years, one member shall be elected for a term of (2) two years, and one shall be elected for a term of one (1) year; in subsequent elections these members shall each be elected for three (3) years. 2.19.030 Vacancy filling. Vacancies on the Board due to death, resignation, or removal of a member shall be filled, in accordance with Colorado Revised Statutes 31-30-1104, to complete the unexpired term of such member. (Ord. 1183-99)
2.19.040 Meetings Rules for operation. The Board shall hold at least one (1) regular meeting per year, the date and time of such meeting to be fixed by the Board. All meetings and records of the Board shall be open to the public. The Board shall keep minutes of its proceedings, showing the vote of each member upon every question, or if absent or failing to vote, indicating such fact, and shall also keep records of its official actions. The Board is empowered to make rules and regulations for its conduct and operation not inconsistent with law and shall fix the manner for holding special meetings and giving notice thereof. A majority of the Board shall constitute a quorum for the transaction of business. (Ord. 1183-99)
2.19.050 Organization and officers. The Officers of the Volunteer Firefighter Pension Board shall be a President and Secretary both of which shall be elected by the members of the Board. The elected officers shall hold office for one (1) year or until their successors are elected. The City Treasurer shall serve as the ex-officio Treasurer of the Board. (Ord. 1183-99)
2.19.060 Powers and duties. The Board shall perform the following duties:
A. Act in an advisory capacity to the City Council regarding matters relating to the Volunteer Firefighter Pension program.
B. Adopt necessary rules not inconsistent with Title 31, Article 30, Part 11, of the Colorado Revised Statutes for the management and protection of the volunteer pension fund.
C. Hear and decide each application for volunteer pension fund benefits.
D. Keep and preserve a record of action and all other matters properly before the Board.
E. Make recommendations on any related subject as requested by the City Council.
F. Perform other duties specified in Title 31, Article 30, Part 11 of the Colorado Revised Statutes. (Ord. 1183-99)
