15.56.010 Definitions. For the purpose of this chapter, certain terms and words are herewith defined as follows:
A. "Private pool" means any receptacle for water or artificial pool of water designed, used and maintained for swimming, bathing or recreation purposes by an individual for use by the individual’s household and guests, having a depth at some point greater than twenty four inches and/or a water surface area exceeding one hundred fifty square feet, and located on a lot as an accessory use to a residence.
B. "Public or semipublic pool" shall mean as defined in the rules and regulations of the State Department of Public Health and the Weld County board of health, and shall be constructed, operated and maintained accordingly. (Ord. 1134-98, 1998: Ord. 356-77, 1977)

15.56.020 Permit Required. Permits and permit fees for all private, public or semi-public pools shall be in accordance with the fees as established in the Uniform Building Code as adopted by the City Council. (Ord. 1134-98, 1998: Ord. 356-77, 1977)

15.56.030 Permit Application Submittal Documents. All applications for a permit for construction, installation, enlargement or alteration of a private, public or semi-public pool shall be in accordance with requirements as established in the Uniform Building Code as adopted by the City Council. 15.56.040 Fences, gates and doors. All private, public or semi-public pools shall be completely sur-rounded by a fence enclosure having intermediate rails or an ornamental pattern such that a sphere four inches (4") in diameter cannot pass through and must be not less than four feet in height, provided, however, that another structure may form portions of the required enclosure. All gates or doors opening through an enclosure shall be equipped with a self closing and self latching gate securely closed at all times when not in actual use, with such latch located so as to prevent small children from opening any door or gate; provided, however, that the door of any building forming any part of the enclosure hereinabove required need not be so equipped. 15.56.050 Water supply. The water supply to any pool shall be installed as required by the Uniform Plumbing Code, as adopted by the City Council, and no potable water supply shall be introduced into a pool or appurtenances thereof by either direct connection or hose line unless such connection is installed in accordance with the Uniform Plumbing Code and State Health Department regulations.  15.56.060 Wastewater discharge conditions Pools.
A. Wastewater from any private, public or semi-public pool shall be discharged into a storm sewer, if such is available, and shall be done in accordance with plans approved by the utilities director. The discharging of wastewater from any private, public or semi-public pool into a public sanitary sewer is strictly prohibited except in cases where a special permit has been authorized by the utilities director. The Evans Water & Sewer Board, with the final approval of City Council, is hereby authorized to establish rates and charge fees consistent with costs associated with the processing of such wastewater.
B. Where space and conditions are such that no hazard,
nuisance or unsanitary condition will result, pool wastewater may be used for irrigation by surface or subsurface irrigation.
C. Submittal documents presented as part of an application for a building permit to install a pool discharge line shall include sufficient information and details in order to determine the proper place and type of connection with the drainage system. The utilities director may grant special permission to discharge water from a pool at a curb or upon the surface of any street provided that no hazard, nuisance or unsanitary condition will result. 15.56.070 Violation Penalty. Any person who violates any of the provisions of this chapter is guilty of a violation of this chapter and shall be punished as provided in Section 1.16.010. (Ord. 1134-98, 1998: Ord. 842-92, 1992: Ord. 356-77, 1977)
