A. Pursuant to Title 31, Article 16, Part 2 of Colorado Revised Statutes 1973, as amended, there is adopted as the energy efficiency construction and renovation standards for nonresidential buildings of the city, by reference thereto, the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings, adopted November, 1977, and published March, 1978, by the state of Colorado, Office of State Planning and
Budgeting, Board for Energy Efficient Non residential Building Standards, 1525 Sherman Street, Denver, Colorado, 80203, and as the energy efficiency construction and renovation standards for residential buildings of the city, by reference thereto, the Colorado Recommended Energy Conservation "Performance" Code for New Construction and Renovation of Residential Buildings, adopted November, 1977, and published March, 1978 by the state of Colorado, Division of Housing, State Housing Board, 1313 Sherman Street, Denver, Colorado, 80203, both to have the same force and effect as if set forth herein in every particular.
B. The subject matter of the adopted standards includes comprehensive provisions and standards regulating energy efficiency in the design, construction, renovation, erection, enlargement, alteration, repair, conversion, occupancy, equipment and maintenance of certain nonresidential and residential buildings and structures for the purpose of protecting the public health, safety and general welfare. 15.36.020 Copies on file in city clerk's office. At least three copies of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings and Colorado Recommended Energy Conservation "Performance" Code for New Construction and Renovation of Residential Buildings, which may be found at Appendix B of the preceding mentioned code, shall be on file at the office of the city clerk for inspection by the public. 15.36.030 Section 108.0 added Administrative and appeal procedures. Section 108.0 is added to the code adopted in Section 15.36.010 of this chapter, to read as follows:
108.0 Administrative and Appeal Procedures. Administrative and appeal procedures set forth in Sections 201, 202, and 204, and Chapter 3 of the Uniform Building Code, 1982 Edition, shall be applicable and followed in the administration of this code. (Ord. 380 78, 1978)

15.36.060 Section 701.0 amended Definitions. Section 701.0 of the code adopted in Section 15.36.010 is amended by addition of the following:
SMACNA refers to Sheet Metal and Air Conditioning Contractors National Association. NESCA refers to National Environmental System Contractors Association. NWMA refers to National Woodwork Manufacturers Association, Inc. (Ord. 380 78, 1978)
15.36.070 Violation Penalty.
A. It is unlawful for any person, firm or corporation to erect, construct, renovate, enlarge, alter, repair, improve, convert, equip, use, occupy or maintain any building or structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings, or the Colorado Recommended Energy Conservation "Performance" Code for New Construction and Renovation of Residential Buildings.
B. Any person, firm or corporation violating any of the provisions of the Colorado Model Energy Efficiency Construction and Renovation Standards for Nonresidential Buildings, or the Colorado Recommended Energy Conservation "Performance" Code for New Construction and Renovation of Residential Buildings, or of this chapter, shall be punished by a fine not exceeding one thousand dollars ($1,000.00) or by imprisonment not exceeding one (1) year, or by both such fine and imprisonment. Each and every day or portion thereof during which any such violation is committed, continued or permitted shall be considered a separate offense. (Ord. 842-92, 1992: Ord. 380 78, 1978)
