15.16.010 Document adopted by reference. Pursuant to Colorado Revised Statutes 1973, 31-16-201 et seq., as amend¬ed, there is hereby adopted as the plumbing code of the City, by reference thereto, the International Plumbing Code, 2006 Edi¬tion, and the installation standards thereto, published by the International Code Council (ICC), 4051 West Flossmoor Road, Country Club Hills, IL 60478-5795. 15.16.020 Title for Citation. The ordinance codified in this chapter may be known and cited as "the Plumbing Code for the City of Evans, Colorado." (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.030 Purpose. The purpose of this plumbing code is to provide minimum standards to safeguard life or limb, health, property and public welfare by regulating and con¬trolling the design, construction, installation, quality of materials, location, operation and maintenance or use of plumbing equipment and systems within this jurisdiction. 15.16.040 Scope of provisions. The provisions of this plumbing code shall apply to the erection, installation, alter¬ation, repair, relocation, replacement, addition to, use or maintenance of plumbing equipment and systems within this jurisdiction. (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.050 Interpretation of provisions. This chapter shall be so interpreted and construed as to effectuate its general purpose to make uniform plumbing regulations. (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.060 Applicability. This chapter shall apply to every building or structure (except one and two family dwellings) as defined in said ordinance, which is now in existence or which may hereafter be erected, altered, moved, demolished or repaired. (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.070 IPC Section 106.6.2 is amended to read:
Section 106.6.2 Permit Fees.

15.16.80 IPC Section 106.6.2.1 is amended to read:
Section 106.6.2.1 Plan Review Fees.
When a plan or other data is required to be submitted by 106.5.1, a plan review fee shall be paid at the time of submitting plans and specifications for review or at the time of permit issuance to be determined by the Building Official. The plan review fees for plumbing work shall be set forth by resolution as adopted by City Council. The plan review fees specified in this subsection are separate fees from the permit fees specified in this section and are in addition to the permit fees.
When plans are incomplete or changed so as to require additional review a fee shall be charged as set forth by resolution as adopted by the City Council. (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.090 IPC Section 106.4.1 is added to read:
Section 106.4.1 State License Required.
(a) No person shall engage in or work at the business, trade, or calling of a residential, journeyman or master plumber in the City of Evans until he/she has received a license from the division of registrations upon written notice from the Colorado State Examining Board of Plumbers or its authorized agent, or a temporary permit from the board or its authorized agent.
(b) A residential plumber shall not perform plumbing work of a type which is beyond the authorization of the state license held. (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.100 IPC Section 109 is amended to read:
Section 109 Board of Appeals.
(a) General. In order to hear and decide appeals of orders, decisions or determinations made by the building official relative to the application and inter¬pretations of this code, there shall be and is hereby created a Board of Appeals consisting of members who are qualified by experience and training to pass upon mat¬ters pertain¬ing to plumbing systems and who are not employees of the jurisdic¬tion. The building official shall be an ex officio member and shall act as secretary to said board but shall have no vote upon any matter before the board. The Board of Appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business and shall render all deci¬sions and findings in writing to the appellant with a duplicate copy to the building official.
(b) Limitations of Authority. The Board of Ap¬peals shall have no au¬thority relative to inter¬preta¬tion of the admin¬istra¬tive provi¬sions of this code nor shall the board be empow¬ered to waive re¬quire¬ments of this code. (507-11: 266-04: 076-01: 1134-98: 865-93: 557-83)
15.16.120 Section 916.1.2 is added to read:
Section 916.1.2 Size of Vent System
The drainage piping of each building and each connection to a public sewer or a private sewage disposal system shall be vented by means of one or more vent pipes extending through the roof, the aggregate cross-sectional area of which shall not be less than that of the largest required building sewer as determined by Table 710.1(1). 15.16 130 Section 917.3.4 is added to read:
In addition to the relief vent sizing in accordance with section 916.2, the relief vent system shall also be sized in accordance with Section 916.1.2. The aggregate cross-sectional relief vent area shall not be less than that of the largest required building sewer as determined by Table 710.1(1). (507-11: 266-04)
15.16.140 Violation--Penalty.
A. It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the city, or cause the same to be done, contrary to or in violation of any of the provisions of the code adopted in this chapter.
B. Any person, firm or corporation violating any of the provisions of the code adopted in this chapter shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code are committed, continued or permit¬ted, and upon conviction of any such violation, such person shall be punishable by a fine of not more than one thousand ($1,000) dollars, or by imprisonment for not more than one (1) year, or by both such fine and imprisonment.
