13.05.040 Application.
13.05.010 Depth of water mains and service lines. Unless otherwise specified by ordinance, or unless otherwise required or approved by the director of public works, the minimum depth of cover for all water lines from the finished grade to the top of the pipe shall be:
A. Four and one half feet for pipelines twenty inches and smaller;
B. Four feet for pipelines larger than twenty inches. (Ord. 616 85, 1985)
13.05.020 Violation unlawful Penalty. Any person who locates, constructs or lays a water pipeline in violation of Section 13.05.010 is guilty of a misdemeanor and, upon conviction, shall be fined not to exceed one thousand dollars ($1,000.00). Each day a violation continues shall be a separate offense. (Ord. 842-92, 1992: Ord. 616 85, 1985)
13.05.030 Damages.
A. Any person who constructs a pipeline in violation of Section 13.05.010 which is located in a street, alley or other easement of the city shall be liable to the city for all costs of repair caused by the freezing of water in the pipeline, or caused by pressures created by ice in the pipeline.
B. Any person who constructs a pipeline on private property in violation of Section 13.05.010 shall be liable to the property owner for the costs of all repair caused by the freezing of water in the pipeline, or caused by pressures created by ice in the pipeline. (Ord. 616 85, 1985)
13.05.040 Application. This chapter shall apply to all pipelines constructed or installed within the city distribution system. (Ord. 616 85, 1985)
