12.10.010 Legislative Intent. The City Council does hereby find that regulation of private access to public streets is necessary to protect the public health, safety and welfare to maintain smooth traffic flow, to maintain highway right-of-drainage, and to protect the functional level of public streets. 12.10.020 Access Permit Required. No private access to a public street or roadway shall be constructed without the issuance from the Public Works Department of an access permit. The issuance of an access permit shall be based upon consideration of existing and projected traffic volumes, the functional classification of the public roadway or street, local transportation plans and needs, drainage requirements, the character of lands adjoining the streets, adopted land use plans and zoning, the type and volume of traffic to use the driveway or other access, other operational aspects of the access, the availability of vehicular access from other streets and roadways, and reasonable access requirements. 12.10.030 Prior Access Construction. All accesses to public streets constructed prior to the effective date of the provisions of this Chapter are hereby confirmed provided that such access does not pose a danger to the public health, safety and welfare and further provided that all conditions of the previously permitted access, including any development standards have been met, maintained, and are not currently in violation of any City requirements including, but not limited to, City safety standards and/or development agreements, regulations and requirements. 12.10.040 Violations. When a permitted access is constructed or utilized in violation of the provisions of this Chapter, any permit issuance, terms, and conditions, development agreements or requirements, the City may revoke the access permit if one has been granted or if not, upon the issuance of reasonable notice, the City may install barriers across or remove any driveway providing direct access to a City street or roadway which is constructed without the appropriate permit or that is otherwise in violation of this Chapter. 12.10.050 Violation -- Penalty. A person who violates the requirements of this Chapter shall be punished by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment of not more than one (1) year or by both such fine and imprisonment. (Ord. 274-04)
