12.08.010 Permit Required when. It is unlawful to cut or open any paved street or alley in the city without first obtaining a permit to make such cut or opening from the city clerk's office. (Ord. 265, 1973)
12.08.020 Permit Bond requirements. A performance bond shall be furnished and paid by the applicant and delivered to the city clerk prior to the issuance of any street cut permit. The bond shall be in the amount of one thousand dollars, and so drawn that the city of Evans may recover such costs as it may incur in any corrective work or repairing of faulty street cuts and excavations. Utility franchise holders shall be exempt from submitting such performance bond. (Ord. 265, 1973)
12.08.030 Permit Denial of issuance. The city clerk, upon recommendation of the city manager, shall withhold issuance of a street cut permit to applicants who have failed to follow the regulations for street repairs in previous street cuts. (Ord. 265, 1973)
12.08.040 Cuts in pavement Technical specifications Resurfacing. The city manager shall promulgate technical specifications for the repair of street cuts and excavations, and establish a resurfacing fee, and provide for the inspection and acceptance of street cut repairs. (Ord. 265, 1973)
12.08.050 Cuts in pavement Dimensions and other requirements.
A. Authorized and allowable curb cuts by the city manager or city engineer shall be as follows:
1. Commercial cuts: thirty five feet maximum;
2. Residential cuts: Twenty four feet maximum.
B. All curb cuts shall be done in a workmanlike manner, and there shall be a minimum of ten feet between curb cuts.
C. In manufacturing or industrial zones, as approved in the official zoning map, the city manager or city engineer may permit valley gutters and other types of curbs which do not need curb cuts. (Ord. 265 (part), 1973)
12.08.060 Variances from chapter provisions. Applications for a variance to the provisions of this chapter may be made to the city council, and the city council shall have the authority to grant such variances. (Ord. 265, 1973)
